Calorie0 Terms of Service

1. Acceptance of Terms
By accessing or using Calorie0 (the "Platform"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform. Continued use after any update constitutes acceptance of the revised Terms.

2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. By registering, you self-certify that you meet this requirement. Calorie0 does not independently verify age. If we discover a user is underage, the account will be terminated and associated data deleted.

3. Medical and Health Disclaimer
Calorie0 provides educational content related to fitness, nutrition, and healthy habits. Nothing on the Platform constitutes medical advice, diagnosis, or treatment. Always consult a qualified medical professional before making changes to your workout routine, diet, or health behaviour — particularly if you have a pre-existing condition, injury, or are pregnant.

4. Account Security
You are responsible for all activity under your account and for keeping your login credentials secure. Do not share your account or impersonate another person. If you suspect unauthorised access, contact us immediately at hello@calorie0.com.

5. User Responsibility
If you follow workouts, nutrition plans, or any guidance found on Calorie0, you do so voluntarily and at your own risk. You are solely responsible for your choices, participation, physical exertion, and outcomes.

6. Coaches and Independent Professionals
Coaches, trainers, and other professionals listed or accessible through the Platform are independent third-party providers, not employees or agents of Calorie0. Calorie0 does not conduct background checks on these individuals and does not guarantee the accuracy, safety, or suitability of their advice. Engage with any professional at your own discretion.

7. Paid Services, Billing, and Refunds
If you purchase any paid plan or service, you authorise Calorie0 to charge your selected payment method. All prices are displayed before purchase. Where required by applicable law (including EU/UK consumer law), you have a 14-day cooling-off period from the date of purchase for digital services, unless you have already accessed or begun using the service. Subscription plans auto-renew unless cancelled before the renewal date. To cancel, visit your account settings or email hello@calorie0.com. Refunds outside of statutory rights are at Calorie0's sole discretion.

8. No Guaranteed Results
Results from using Calorie0 vary by individual, consistency, and other factors outside our control. We make no guarantee of weight loss, muscle gain, performance improvement, or any other health outcome.

9. User Content
You retain ownership of content you submit (workout logs, posts, comments, photos). By submitting content, you grant Calorie0 a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, display, distribute, and use that content solely to operate and improve the Platform. You represent that you have the rights to any content you submit and that it does not infringe any third-party rights.

10. Prohibited Conduct
You may not use the Platform to engage in abuse, harassment, hate speech, fraud, impersonation, spam, bot activity, scraping, malware distribution, unauthorised access, or the spread of dangerous health misinformation. Violations may result in immediate account suspension or termination.

11. Platform Integrity
Streaks, leaderboards, badges, and engagement metrics are maintained for accuracy. Calorie0 reserves the right to adjust these for anti-fraud purposes, technical corrections, moderation decisions, or policy enforcement without prior notice.

12. Intellectual Property
All Platform content, branding, software, and design not submitted by users is owned by or licensed to Calorie0. You may not copy, reproduce, distribute, or create derivative works from Platform content without express written permission.

13. Suspension and Termination
Calorie0 may suspend or terminate your account for Terms violations, fraud, abuse, legal non-compliance, or security threats. Where reasonably practicable, we will provide advance notice and a reasonable opportunity to export your data before termination, unless the violation requires immediate action to protect users or the Platform. You may also delete your account at any time from your account settings.

14. Disclaimers
The Platform is provided "as is" and "as available." To the maximum extent permitted by applicable law, Calorie0 makes no warranties, express or implied, regarding fitness for a particular purpose, accuracy, reliability, or uninterrupted access.

15. Limitation of Liability
To the fullest extent permitted by law, Calorie0 and its officers, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of (or inability to use) the Platform. Where liability cannot be excluded by law, our total liability is limited to the greater of (a) the amount you paid us in the 12 months prior to the claim or (b) USD $100.

16. Indemnification
You agree to indemnify, defend, and hold harmless Calorie0 and its affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your content, your conduct on the Platform, or your violation of these Terms.

17. Disputes and Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes informally by contacting hello@calorie0.com. Nothing in this section limits your statutory consumer rights or your right to report concerns to a relevant regulatory authority in your jurisdiction.

18. DMCA / Copyright Complaints
To report copyright infringement, email hello@calorie0.com with: (1) identification of the copyrighted work; (2) identification of the infringing material and its URL; (3) your contact information; (4) a statement of good-faith belief; and (5) a statement of accuracy under penalty of perjury.

19. Feedback and Suggestions
If you submit feedback, ideas, or suggestions about the Platform, you grant Calorie0 an irrevocable, perpetual, worldwide, royalty-free licence to use, reproduce, and incorporate that feedback into the Platform or other products without any obligation or compensation to you. You waive any moral rights in such submissions to the extent permitted by law.

20. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Calorie0 may assign or transfer these Terms — in whole or in part — to an affiliate or in connection with a merger, acquisition, corporate reorganisation, or sale of substantially all of its assets, with notice to you. These Terms will be binding on and inure to the benefit of the parties' permitted successors and assigns.

21. Force Majeure
Calorie0 will not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, internet or telecommunications failures, cyberattacks, power outages, or third-party service provider failures. We will make reasonable efforts to resume normal operations as soon as practicable.

22. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms will continue in full force and effect.

23. No Waiver
Calorie0's failure to enforce any right or provision of these Terms on one occasion will not constitute a waiver of that right or provision on any future occasion. Any waiver must be in writing and signed by an authorised representative of Calorie0 to be effective.

24. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms presented at the point of purchase, constitute the entire agreement between you and Calorie0 regarding the Platform. They supersede all prior or contemporaneous agreements, representations, warranties, and understandings — whether written or verbal — relating to the Platform.

25. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date and, where required, notify you by email or in-app notice. Continued use after the effective date of any update constitutes acceptance.
